BC's court fees deemed unconstitutional

VANCOUVER (NEWS1130) – A lawyer who has fought against expensive court fees in BC admits he’s a little surprised a BC Supreme Court Justice is calling them unconstitutional.

“It’s taken I think 15 months. All I can say is wow. This is a surprise today,” says Darrell Roberts with the Trial Lawyers Association of BC.

He is still reading over the 178-page ruling that was handed down today after two years by BC Justice Mark McEwan. Roberts says the average Canadian can’t afford to pay the excessive fees that are being charged in some cases.

“They amount up to thousands of dollars for any case that takes any time, such as a week of more. This has impact for everybody.”

Roberts says he won’t be surprised if the provincial government appeals the decision.
