New trial ordered for cab driver convicted of assault

SURREY (NEWS1130) – A new trial has been ordered for a cab driver who was convicted of sexually assaulting one of his teenage passengers.

The cabbie and the girl have different stories about what happened that night.

Wasim Malik picked up two teenage girls in Surrey three years ago. They’d been drinking and they asked Malik to take them to a party in Fort Langley.

When they got there, there was no party and they’d racked up a fare of close to $100

Malik dropped one of the girls off and drove the other teen to his home in Surrey. Malik claims they were kissing and they were going to go further, consensually, but the 17-year-old backed out and left.

The girl claims Malik walked over to her in a bathrobe and she had to squirm away when he started kiss her.

BC’s highest court says the trial judge relied on text messages that weren’t credible as evidence and Malik will get a new trial.
