Case of BC father accused of killing daughters put off until February

OAK BAY (NEWS 1130) – A Vancouver Island father accused of killing his two daughters on Christmas Day will stay in custody for at least the next month as he finds a lawyer.

Andrew Berry, 43, wore a grey hoodie and did not speak during his first scheduled court appearance Thursday where his duty counsel asked to have the case adjourned until Feb. 1, so Berry could retain permanent legal counsel. The appearance was originally scheduled as a bail hearing.

“They are generally provided an opportunity to seek legal counsel, if they choose, and that’s what happened in this case,” Dan McLaughlin with Crown Counsel said. “He has requested an adjournment and the matter has been adjourned until February 1st to allow an opportunity to consult legal counsel and seek legal advice.”

Berry will remain in custody at least until his next court appearance.

The Oak Bay father is charged with two counts of second-degree murder following the deaths of Aubrey Berry and Chloe Berry.

The girls, aged four and six respectively, were found dead in an apartment when police responded to reports of a “potential incident” on Christmas Day.

A friend of the family said the children’s mother notified police that her former common-law spouse hadn’t returned the girls as scheduled.

Berry was found at the scene with described self-inflicted injuries. He was treated in the hospital and charged after his release.

Court documents show Berry was granted time with his children following a custody battle last year between his estranged common-law partner.
