Duke and Duchess of Sussex’s lawyer issues warning to paparazzi

Harry and Meghan’s lawyers issued a stern warning to the media – leave them alone. Members of the paparazzi have been staked outside their “home” in North Saanich. Travis Prasad talks with a privacy lawyer, and more.

VANCOUVER ISLAND (NEWS 1130) – Prince Harry and his wife Meghan Markle haven’t been in B.C. long but their lawyer has already issued a warning to paparazzi.

Photographers have apparently been camped outside of their Vancouver Island home around the clock, snapping photos of the couple without their consent.

Those living in the area appear to understand the frustration.

“Harry’s mother died because of all the attention that was on her and it was very tragic. I’m sure they’re both just want to break away and have a safe haven, just somewhere they can live a normal life,” says one neighbour.

Prince Harry and Megan Markle’s lawyer says any images recorded without permission will lead to legal action on the grounds of violating their privacy.

But lawyer Ryan Berger says the paparazzi may have a strong defense in this province.

“One of the defenses under the privacy tort in British Columbia is whether there is a public interest in the recording or the filming or publication,” he says. “And so certainly there is a public interest in the Royals, even if they’ve denounced their royal status.”

Earlier in the week, Prince Harry called the decision to step away from royal duties a tough but necessary move for the sake of his family.

As for Prince Harry and Megan’s legal threat against paparazzi privacy, Berger says a more serious charge could actually work for the Royals down the road.

“If people are photographing or videotaping them inside of more private areas and following them repeatedly to the extent where there is some fear of harm, then that might eventually arise to a criminal harassment level.”

Over the weekend Buckingham Palace announced the Duke and Duchess of Sussex were to stop using their ‘Royal Highness’ titles as they take a step back from roles as Senior Royals.
